NO-FAULT INSURANCE

New York No-fault auto insurance laws require every driver to file a claim with their own insurance company within 30-days after an accident, regardless of who was at fault, and it covers up to 50,000 dollars of accident-related expenses.

To qualify for no-fault benefits, you must be a motor vehicle operator, passenger, pedestrian, or bicyclist. You must file an NF2 form with the proper insurance carrier within 30 days of the accident. Failure to do so may result in the denial of your no-fault benefits.

In most cases, the following people would not be eligible for no-fault coverage:

  • Motorcycle drivers.
  • Motorcycle passengers.
  • If you are in your uninsured vehicle, there is no coverage for you.
  • If you occupy your spouse’s uninsured vehicle, there is no coverage for you.

Independent Medical Examination 

An Independent Medical Exam (IME) is a physical examination with a doctor hired by a no-fault insurance carrier. Failure to go to your IME appointment is a policy violation, and because of that, your no-fault benefits will be terminated, and you will be personally responsible for all of your medical bills. But if your No-fault benefits are terminated based on the Insurance company doctors' opinion, you can continue the treatment and you will not be personally responsible for any of your medical bills up to your policy limit.

Examination under oath 

Your no-fault carrier does examination under oath (EUO). In which they will ask you the questions about the accident, injuries, and treatment you are receiving. Failure to go to your EUO appointment is a policy violation, and because of that, your no-fault benefits will be terminated and you will be personally responsible for all of your medical bills.
